Acceptance and Agreement to these Terms
This Agreement constitutes a legally binding contract between you and PIXIE Soft Play Party Rentals, LLC, and others who may interact or interface with PIXIE Soft Play Party Rentals, LLC.
It is the sole responsibility of the client “renter” to read the terms and conditions before proceeding to use this site. If you do not expressly agree to these terms and conditions please do not proceed to access our site or book our services. By continuing forward, you hereby agree to be bound by all Terms and Conditions
These Terms and Conditions are an agreement between you (“client”, “renter”, “customer”, “The Lessee”) and PIXIE Soft Play Party Rentals, LLC (“we”, “us”, “The Lessor”). The Website and all information contained therein is owned and operated by PIXIE Soft Play Party Rentals, LLC., and will also be abbreviated or referenced as PIXIE Soft Play, a company formed and operating in accordance with the laws of California, United States of America
The Lessee hereby acknowledges that they have read and understood the Terms and Conditions as outlined in this rental agreement. By proceeding with the booking, the Lessee accepts all terms of this rental agreement
Changes to these Terms
These Terms and Conditions are subject to change from time to time. It is the client responsibility to review them for any changes. The revised Terms and Conditions still indicate your acceptance and agreement to be bound by them when using our website
Copyright
The website (www.pixiesoftplay.com) and its content that includes but not limited to: photos, images, videos, other promotional material is the property of PIXIE Soft Play Party Rentals, LLC and is protected by United States, California, copyright, trademark and other laws. Your use of the Website does not transfer to you any ownership, or other rights in the Website or its content
Ownership
Client is prohibited to sublet or sell rental equipment provided by PIXIE Soft Play Party Rentals
Rental Policy
PIXIE Soft Play Party Rentals LLC provides rental equipment to renter on a temporary basis only for limited use by the renter within the terms of this agreement. Rentals are for the agreed-upon start and end time of your event, unless otherwise stated or agreed. All rentals are subject to availability. PIXIE Soft Play Party Rentals LLC at its sole and absolute discretion reserve the right to decline services and terminate a contract to any individual or entity, for any reason, and without prior notice. This includes but is not limited to product resources, operational services, safety risk, violation of our policies, or conduct deemed inappropriate by PIXIE Soft Play
Rental Includes: Day rental, delivery, set up, and collection. *Delivery fee is determined by city where event will be held
We do not prorate rental equipment or offer onsite pickup
Hours of Operation:
Business Hours: Mon – Thurs: 9am – 3pm Friday: 9am – 5pm Saturday-Sunday: CLOSED (Open for delivery only)
Booking Hours: Monday – Sunday from 9:00am – 6:00pm.
Collection of Equipment: (outdoor) 5:00pm and (indoor) 6:00pm.
Please Note: We do not set up at parks during (Oct-Apr) *Exceptions may apply for set up held at indoor park community centers
Additional hours outside our normal booking hours is an option for a fee of $50/hr. Add on hours must be made and paid at least 14 days in advance and subject to availability. *Excludes park reservations
Client shall designate an area that meets the minimum space dimensions required for our equipment. PIXIE Soft Play sets up equipment according to area and reserve the right to not place items that can not be accommodated inside the play area. NO refunds issued for equipment that does not properly fit inside the play area
For special accommodations, please contact us at info@pixiesoftplay.com to discuss availability. Late accommodations are subject to availability and cannot be guaranteed
Deposit and Reservation
Quotes or proposals do not guarantee availability of rental equipment. Reservation and 30% deposit is due at the time of booking. A $300 minimum order is required not including security deposit and fees. We reserve the right to cancel booking if minimum requirement is not met.
Booking confirmation is sent via email once payment is processed. Please check junk or spam email if you do not receive email confirmation within 24 hours of processing payment and contact us directly for any questions
Payments
Client will receive invoice five (5) business days prior to event. The remaining balance must be paid in full (3) days before the event date. Failure to pay remaining balance by due date will result in cancellation of and forfeiture of total deposit
Forms of Payment
We accept credit, debit and third party payment plans. All payments are processed through our website payment portal. No cash or checks accepted
Agreements
It is the clients responsibility to fully read carefully and acknowledge the Waiver and Release of Liability and Terms and Conditions agreement prior to finalizing reservation
Security Refundable Deposit
Security refundable deposit of $100 is required at the time of booking to secure reservation. Deposit is refunded via the original form of payment within seven (7) business days after your event. Security deposit will not be refunded if equipment is returned excessively dirty, wet, torn, punctured, stained, soiled, or loss. Moving soft play from its original set up area and items found outside of area including balls will result in forfeiture of deposit. Full or partial security deposit may be refunded to client if one or more rental items booked and is not a result of release of liability of its entirety

We gladly service the Los Angeles County, Orange County and neighboring cities
Delivery Fees
We offer free delivery within 10 miles of 91709. Areas outside radius will incur a delivery fee at the time of booking. Please email us at info@pixiesoftplay.com to see if delivery is available in your area. We reserve the right to decline service and deliveries we deem unsafe or outside our service area
Additional Fees
Additional fees applies to but not limited to custom orders; deliveries outside service area; events held in public/private venues and parks; stairs and 2nd floor + set up, narrow pathways and obstructions such as but not limited to vehicles, trash cans, uneven pavement, furniture, etc., that restrict delivery team from using carts to transport equipment, parking and/or walking distance to location site is more than 100ft from unloading zone, etc.,. Renter is required to check the applicable box at the time of booking. Fee will be deducted from security deposit if client is unaware of the restriction(s) at the time of booking
Changes
Request modifications on existing reservation at least five (5) business days prior to your event, accommodation not a guarantee and subject to availability
Reschedule
A one time reschedule change is complimentary when requested at least twenty (20) days before the original event date and needs to be made within one (1) year of original booking date. Deposit will be applied to future date and all of the provisions in this agreement will continue to apply, accommodation not a guarantee and subject to availability. *Deposit is forfeited after one (1) year from original booking date
Cancellations and Refunds
Cancellations for any reason made thirty (30) business days prior to event will receive a full refund. Cancellations made less than thirty (30) business days prior to the event will result in loss of the total deposit
PIXIE Soft Play reserves the right to cancel booking due to unsafe weather conditions or unforeseen circumstances. In the event of a cancellation, deposit will be refunded or applied to a future date within the same calendar year, accommodation not a guarantee and subject to availability

Inspection
It is the sole responsibility of the renter to inspect equipment and address any pre-existing damage to a PIXIE member at the time of delivery. Renter is solely liable for damages including, but not limited to stains, tears, broken or missing items caused by negligence and improper use of equipment
Once rental equipment is returned a PIXIE Soft Play member conducts an thorough inspection of the equipment and documents any newfound damage. Renter is notified via email of any damages and fees within seven (7) business days
Equipment
Client is prohibited from moving, adjusting or servicing rental equipment, to ensure the safety and proper use of equipment. NO EXCEPTIONS. Client shall contact PIXIE Soft Play immediately if equipment is not set up properly or deemed unsafe to use
Decals
Sticky tape, sharp wires/objects, or decals not provided through PIXIE Soft Play are not permitted on any of our equipment without prior written consent. Client is responsible to ensure only removable decals are used on equipment. Security refundable deposit is forfeited and applied to cleaning fee for decals installed through outside vendors
Prohibited Items
PIXIE Soft Play reserves the right to deny service and retain full monies paid if there is any indication of face paint, markers, paint, temporary tattoos, party poppers, water bubbles, confetti (including balloons with confetti), colored streamers, slime, glitter, glue or any ink based products present at the time of delivery. Products permanently stain our equipment and is not to be at your event while our equipment is being used. Please reconsider booking with us if any of these products will be used at your event
Food, drinks, candy, gum, shoes, heels, animals, sharp objects and smoking are strictly prohibited on or near equipment. Client is to ensure participants follow the play rules. NO EXCEPTIONS
Decorations
Balloons and fringe banners can be be easily attached to our bounce house and bubble house exterior. To avoid damage to our equipment a PIXIE Soft Play team member will remove garland during collection. Client is responsible to dispose garland and balloons not provided through us
Recommendation: use #260 or #350 balloon twisters to attach garland
Area Requirements
Renter shall designate a set up area that meets the minimum size requirement and that is CLEAN, DRY, and FLAT. We reserve the right to deny set up on uneven ground, bark, sand, gravel, mulch, dirt/mud, wet areas, slope, or areas we deem unsafe
Equipment approved for outdoor set ups: cut grass, turf, and concrete. PLEASE DO NOT water on or near setup area on the day of your event, as we will not be able to setup on wet grounds
The designated area where the rental equipment will be set up must be cleared by renter prior to our arrival. This includes rocks, sticks, yard debris, pet waste, toys, furniture, objects, etc.,. Failure to properly prepare the set up area in advance will result in loss of security deposit. Please be aware that delivery crew does not move furniture or personal/property items
Electrical Access
Bounce House, Bubble House and Motorized Soft Play equipment require access to a dedicated outlet rated at 115 volts with 20 amperes capacity within 50ft of the set up area. The blower cord shall be plugged into a GFCI outlet and be the only thing operating on that electrical circuit. The number of blowers required to inflate a bounce house may vary depending on size. In locations where adequate electrical is not available, PIXIE Soft Play Party Rentals LLC can provide a generator for an additional fee. Reservations for generators must be made at the time of booking and is subject to availability. We shall not be held liable for any malfunctions that may occur from our generators provided at the event. PIXIE Soft Play will not provide a refund if the rental equipment is found to be inoperable due to inadequate electrical at event location and/or location of outlets, or generators not provided by us
Permits
Renter is responsible to notify us at the time of booking if the venue or park requires a permit, license, proof of insurance, and/or authorizations. If you do not have this information at the time of booking, we ask that you notify us at least seven (7) days prior to event, so we may plan accordingly
Access
It is the responsibility of the client to ensure easy access at the event site for unloading and loading equipment. Any restrictions must be reported to PIXIE Soft Play prior to the event such as but not limited to, lack of parking, stairs, inclined pathways, narrow doorways etc. Failure to do so may result in PIXIE Soft Play not being able to set up equipment. Client is responsible for relating services provided by PIXIE Soft Play to interested parties, including venue staff prior to our arrival
Delivery
Our normal delivery window is Monday-Sunday from 7am-1pm. Park deliveries start at 10am during May – September. We do not set up at parks during October – April
Renter or responsible party is required to be present at delivery. PIXIE Soft Play Party Rentals LLC is not liable for 3rd party actions at delivery site that restrict, or delay set up and breakdown time. Rental equipment set up at public venues and parks shall not be left unattended at any time. Additional fees may apply and must be paid in advance
We will notify you three (3) to five (5) days before your event of your delivery, setup, and pick-up times. Arrival time will be approximately 1-3 hours prior to your selected preferred delivery time and/or event start time (this will not be included in your rental period). A PIXIE Soft Play coordinator may contact you to schedule an earlier or later delivery depending on how many events are scheduled for the day. We will do our best to deliver on time, but PIXIE Soft Play will not be held responsible for delays incurred due to circumstances beyond our control (e.g. traffic delays, weather conditions)
Set Up
Set up will typically take up to one (1) hour depending on package and event unloading area, which may require less or more time. Equipment will only be set up at specified event location. Client is prohibited from moving, adjusting, or servicing the rental equipment
Renter is responsible to ensure that NO animals of any kind are present at setup, during the rental period, breakdown and collection of rental equipment. Failure to comply with this provision shall constitute a material breach of this agreement and grant PIXIE Soft Play the right, in its sole and absolute discretion to immediately terminate this agreement, and will result in forfeiture of monies paid to PIXIE Soft Play Party Rentals LLC
Anchors may be used to secure Bounce House and Bubble House and shall not be removed at any time during the rental period. Renter is responsible to notify PIXIE Soft Play prior to delivery if anchors are not to be used. PIXIE Soft Play set up crew is not responsible for striking or damaging any ground grass/turf or underground utility lines/devices (including but not limited to: electrical, plumbing, sprinkler, etc.). It is the responsibility of the renter to direct the team where equipment is to be set up
Collection
Collection of rental equipment will typically be at the rental end time period agreed upon of your event. Please allow up to one (1) hour grace period after rental time has ended for pickup. Renter shall permit PIXIE Soft Play to remove the rental equipment at the designated end time. Renter is to ensure that all participants clear the equipment area upon arrival
Weather Conditions
We reserve the right to not set up equipment outside if high winds, rain/drizzle or wet conditions are forecast the day of your event. We will not set up on wet grounds if there is residual rain, as it is a safety concern and will cause damage to equipment. Renter shall designate a shaded area or provide protection to soft play equipment for all outdoor events during the summer months. We encourage renter to have an indoor PLAN B option that meets the space requirements prior to the start of your event. Renter assumes all weather-related risks hosting an outdoor event
Cleaning and Sanitization
All equipment is thoroughly inspected, cleaned, disinfected, sanitized and covered before and after each event. We use CleanSmart disinfectant, a non-toxic, fragrance-free, residue-free, hospital grade disinfectant cleaner that kills 99.9% of bacteria, germs, fungus, mold, and viruses. Our ball pit balls are thoroughly cleaned in a commercial grade ball cleaning, sanitation, and drying machine. To ensure the highest level of cleanliness, we never book the same item more than once per day
Safety
It is the responsibility of the renter to consider the safety of themselves and guests during the use of our equipment. Designated set up area must not be too close to any obstructions (3ft gap is recommended) or placed in direct sun (our soft play and mats can get very hot). Adult supervision is required at all times. Renter is to ensure age guidelines are followed according to age group listed in the product information
and is responsible to understand and comply with the venue safety protocols and clearance procedures. Client shall communicate procedures to all parties involved to ensure the safety and proper use of equipment.
PIXIE Soft Play will provide a Safety Rules sign as a courtesy reminder. A complete set of rules is available in the Rental Agreement and Liability Waiver

Representations
Items pictured on PIXIE Soft Play Party Rentals LLC website may not be an exact representation to the rental equipment provided to renter. Renter shall notify PIXIE Soft Play Party Rentals LLC to address concerns and/or changes (color match, color scheme, etc.) at the time of placing the order. All requests made is at the sole discretion of PIXIE Soft Play Party Rentals LLC
Damages
Renter is responsible to return equipment in the same condition in which it was received. Renter agrees to pay the full repair and/or replacement cost for any and all damages to rental equipment. Renter agrees to pay up to $3000.00 (three thousand dollars and zero cents) in reimbursement costs if rental equipment is lost, stolen, or damaged beyond repair. Mat(s) returned punctured, stained, torn, or damaged beyond repair will incur a $25 per mat charge deducted from security deposit. Renter agrees to immediately notify PIXIE Soft Play of any loss, damage or accidents that occur while in possession of equipment
Client agrees to indemnify PIXIE Soft Play for all losses, damages and expenses that are brought against or incurred by us, arising as a result of the same. Client is fully liable for losses, damages and expenses occurred and agree to reimburse PIXIE Soft Play of damages within five (5) business days of the receipt of the claim. In the event of the the failure of the client to make payment to PIXIE Soft Play within the specified time, PIXIE Soft Play has the sole
License and Insurance
We are a fully Licensed and Insured company
Photography and Videography
PIXIE Soft Play Party Rentals LLC has the right and permission to use, display, and publish photographs, videos, electronic representation, and sound recordings made at event, including, but not limited to, proof of delivery, social media, and on website maintained by PIXIE Soft Play Party Rentals. Renter agrees to hereby release PIXIE Soft Play Party Rentals from any and all liability from such use and publication and waives all rights to compensation and approval for any and all published material
Termination of Agreement
PIXIE Soft Play Party Rentals LLC, within its own discretion, determines that Client has failed, in any way, to observe or comply with the conditions of this Rental Agreement, reserves the right to terminate Rental Agreement and initiate whatever actions and/or legal proceedings are necessary to recover rental equipment or said monies. This Agreement and the rights of the parties to this Agreement shall be governed by and construed in accordance with the laws of the State of California. EACH OF THE PARTIES TO THIS AGREEMENT HEREBY IRREVOCABLY WAIVES ANY AND ALL RIGHT TO TRIAL BY JURY IN ANY LEGAL PROCEEDING ARISING OUT OF OR RELATED TO THIS AGREEMENT OR THE TRANSACTIONS CONTEMPLATED HEREBY
